Terms of Use

01 Who these Terms are with

Sensecast is provided by Greigh Studios LLC. These Terms are an agreement between you and Greigh Studios LLC. Apple and Google distribute the App and process payments, but they are not parties to this agreement and are not responsible for the App or for supporting it.

02 Eligibility

You must be old enough to form a binding contract where you live, and at least 13 years old, to use Sensecast. If you are under the age of majority in your jurisdiction, you must have a parent or guardian's permission to make a purchase.

03 Your licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Sensecast on devices you own or control, for your own use, under these Terms. The App, the Sensecast name, the app icon, and the Weather Academy content are owned by Greigh Studios LLC and are protected by copyright and trade mark law. Meteorological data itself remains the property of the agencies that publish it, under their own licences.

04 Weather information and safety

Sensecast presents forecasts, observations, radar imagery, severe convective outlooks, tornado reports and power outage information obtained from public meteorological and government sources. We do not produce this data, and we cannot guarantee that it is accurate, complete, current, or available.

• Forecasts are model output. They are predictions, and they are routinely wrong.
• Alerts and notifications are delivered by your own device and depend on connectivity, background refresh, battery settings and operating system behaviour. A notification may be delayed or may never arrive.
• Upstream services can go down, change, rate-limit, or withdraw data without notice.
• Radar, outage and grid information is provided for general awareness and is not survey-grade.
• The Weather Academy is educational material. It is not professional meteorological, safety, medical or agricultural advice.

You are responsible for decisions you make about travel, work, property, health or safety. Do not use Sensecast as the sole basis for any such decision.

05 Storm reports

The storm report generator assembles publicly available meteorological observations for a time and place you choose, together with anything you add yourself. It is intended to help you document conditions — for example when preparing an insurance claim.

A Sensecast report is not a certified meteorological record, an expert report, or a professional loss adjustment, and we make no representation that any insurer, adjuster or court will accept it. You are responsible for the accuracy of anything you add to a report and for how you use it.

06 Sensecast Pro

Sensecast is free to use. Sensecast Pro is an optional paid upgrade that unlocks the flagship supercomputer forecast models and the other features listed on the Pro page.

Plans and billing

• Monthly — $2.49 per month, auto-renewing.
• Annual — $21.99 per year, auto-renewing, beginning with a 3-day free trial where offered.
• Lifetime Pass — $99.99 once, offered for a limited period at launch. It is a one-time purchase, not a subscription, and grants Pro features for as long as we publish the App. It is not a guarantee that the App will be published, or that any specific feature or third-party data source will remain available, indefinitely.

Prices are in US dollars and may vary by region and applicable tax. We may change pricing for future billing periods; a change never affects a period you have already paid for, and where required we will give advance notice.

Auto-renewal and cancellation

Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the renewal date. Cancel through your Apple ID or Google Play account settings — we cannot cancel a store subscription for you. Access continues to the end of the period you have paid for. If a free trial is offered and you cancel before it ends, you are not charged.

Refunds

All purchases are made through Apple or Google, so refunds are governed by their policies and granted at their discretion, not ours. Google Play offers self-service refunds for a short window after purchase and reviews later requests; Apple publishes no fixed window and decides each request itself through reportaproblem.apple.com. If a store declines a refund you believe you are owed, contact us and we will help where we can, though the final decision rests with the store. Consumer rights that cannot be waived under the law where you live are unaffected by this section.

Verification

Pro entitlements are confirmed with Apple or Google by our verification service. If a purchase is refunded, revoked, expired, or found not to be genuine, the corresponding Pro access ends. See the Privacy Policy for what that service records.

07 Beta and pre-release builds

Sensecast is currently distributed for testing through TestFlight and Google Play closed testing. Pre-release builds are provided as-is for evaluation, may be unstable or incomplete, and are additionally subject to the terms of the testing programme you joined.

• Features in a beta build may change or be removed before release.
• Pro features may be enabled during testing without payment. That access is temporary, carries no value, and ends when the testing period does — it does not become a Lifetime Pass.
• Do not rely on a pre-release build for severe weather awareness.

08 Your own API keys

Sensecast lets you supply your own API key for certain third-party weather services. If you do, your use of that service is governed by your agreement with that provider, you are responsible for any charges or limits on your account, and you are responsible for keeping the key confidential. We do not receive, transmit or store your keys on our servers — see the Privacy Policy.

09 Acceptable use

You agree not to:

• Modify the App, or use a modified or instrumented build, to obtain Pro features without a valid purchase.
• Forge, replay, tamper with, or share a purchase receipt or entitlement, or interfere with the verification service.
• Attack, overload, probe, or attempt to breach our verification service or circumvent its rate limits.
• Scrape, resell, or redistribute data obtained through the App, or use it to build a competing service.
• Use the App in a way that breaches the terms or acceptable-use policies of the upstream weather providers it relies on.
• Reverse engineer the App, except to the extent that restriction is unenforceable under the law that applies to you.
• Remove or obscure any copyright, trade mark or attribution notice.

We may suspend or terminate access, including a Pro entitlement, where we reasonably believe these Terms have been breached.

10 Availability and changes

We may add, change, suspend or discontinue any part of the App at any time, including individual data sources, which we do not control. We aim to keep Sensecast reliable, but we do not promise uninterrupted or error-free operation.

11 Disclaimers and limitation of liability

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the fullest extent permitted by law, Greigh Studios LLC, its members and its personnel are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of or damage to property, business interruption, injury, or other loss arising out of your use of, or reliance on, the App or the weather information it presents. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for Sensecast in the twelve months before the claim, or twenty-five US dollars.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12 App stores

• Your use of the App is also subject to the terms of the store or testing programme you obtained it from.
• Apple and Google have no obligation to provide support or maintenance for Sensecast.
• Apple and Google are not responsible for addressing any claim relating to the App, including product liability, legal compliance, or intellectual property claims.
• Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS and macOS versions, and may enforce them against you.
• You represent that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government restricted-parties list.

13 Termination

You may stop using Sensecast at any time by deleting it, which removes the data described in the Privacy Policy from your device. Deleting the App does not cancel a store subscription — cancel that in your Apple or Google account settings. We may terminate or suspend access if these Terms are breached, or where we must do so for legal or safety reasons.

14 Changes to these Terms

We may update these Terms as the App changes. When we make a material change we will revise the "Last updated" date above. Continuing to use Sensecast after a change takes effect means you accept the revised Terms.

15 Governing law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-law rules. You and Greigh Studios LLC agree that any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of those courts. If you are a consumer resident in a jurisdiction whose law gives you the right to bring proceedings locally, this section does not remove that right.
